These Terms of Service (“Terms”) govern your access to and use of ecommercegoodies.com (the “Site”) and the purchase of products from Ecommerce Goodies LLC (“Ecommerce Goodies,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms and to our related policies, including (as applicable) Shipping & Delivery, Order Changes & Cancellations, Returns & Refunds, Payment Methods, and Privacy Policy.

1) Eligibility & Checkout Information

  • You must be able to form a legally binding contract to use the Site and place an order.
  • You agree to provide accurate, current information during checkout, including your shipping address and contact details.
  • You are responsible for maintaining the accuracy of your delivery information and for any activity conducted through your device.

2) Products & Made-to-Order

Many of our products are made-to-order. Product images, mockups, and descriptions are provided to help you choose the right item. Minor variations can occur, including slight differences in print placement/scale within reasonable tolerance, and color differences due to screen/display settings.

3) Orders, Changes & Cancellations

Once your payment is confirmed, your order begins processing for production and fulfillment. In most cases, you may request changes or cancellation within 24 hours of payment confirmation (for example: size, color, quantity, or shipping address). After that window, your order may already be in production and we may be unable to change or cancel it.

4) Pricing, Taxes & Payment

  • Prices are shown in USD unless stated otherwise.
  • Shipping fees and applicable taxes/fees (if any) are shown at checkout.
  • You authorize us (and our payment processors) to charge the payment method you provide when you place your order.
  • We may cancel or refuse an order if we suspect fraud, unauthorized activity, or abuse.

5) Shipping & Delivery

Delivery timelines are estimates. Production and shipping times vary by product type and destination. Delays may occur due to carrier operations, weather, peak seasons, customs processing, or other circumstances outside our control.

You are responsible for providing a complete and correct shipping address (including apartment/unit number when applicable). If a shipment is returned due to an incorrect/incomplete address, failed delivery attempts, or similar issues, re-shipping fees may apply as described in our Shipping & Delivery Policy.

6) Returns, Replacements & Refunds

Because many items are made-to-order, we do not accept returns for change of mind (including ordering the wrong size) unless required by law. If your order arrives damaged, has a manufacturing/printing defect, or you receive the wrong item (different from what you ordered), we will make it right.

  • Claim window: Contact us within 14 days of delivery with your order number and clear photos of the issue.
  • Resolution: Depending on the situation, we may offer a replacement, store credit, or a refund (full or partial).
  • Returns: Do not mail items back unless we explicitly approve and provide instructions.

7) Chargebacks & Customer Support

If you have an issue with an order, please contact us first so we can help resolve it. We reserve the right to investigate and respond to suspected fraud, abuse, or unauthorized transactions, including refusing service or limiting purchases where appropriate.

8) Intellectual Property

The Site and its content (including text, graphics, logos, photos, and design elements) are owned by or licensed to Ecommerce Goodies and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

9) Prohibited Use

  • Attempting to interfere with Site security, availability, or performance (including scanning, scraping, or DDoS attempts).
  • Using the Site for unlawful, fraudulent, or abusive activities.
  • Uploading malware or attempting unauthorized access to systems or data.

10) Disclaimer

To the extent permitted by law, the Site and products are provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted or error-free. Some jurisdictions do not allow certain warranty disclaimers, so some limitations may not apply to you.

11) Limitation of Liability

To the maximum extent permitted by law, Ecommerce Goodies will not be liable for indirect, incidental, special, consequential, or exemplary damages. Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product(s) giving rise to the claim.

12) Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, including carrier disruptions, customs delays, severe weather, natural disasters, labor disputes, government actions, interruptions of services, or other force majeure events.

13) Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of laws principles. To the extent permitted by law, any disputes will be brought in state or federal courts located in Minnesota, and you consent to their jurisdiction.

14) Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15) Entire Agreement

These Terms and our related policies constitute the entire agreement between you and Ecommerce Goodies regarding the Site and your purchases, and supersede any prior or contemporaneous understandings.

16) Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Site after changes become effective means you accept the updated Terms.
